In California, only people that have been approved by the State of California Department of Justice (Cal-DoJ) and possess a Fingerprint Rolling Certification can take and submit your fingerprints.
Per Cal-DoJ, they recommend that everyone who possesses a Fingerprint Rolling Certification “should display this certificate at the location where you are rolling fingerprint impressions so that the applicants are aware that you have been certified through the DOJ Fingerprint Rolling Certification Program.
The California Department of justice regulates that any live scan service provider must keep the request for live scan service form for a period of 1 year. Once the one-year time frame passes, Live Scan Service Providers are required to cross shred and dispose of the forms.
Contact the company where you were fingerprinted. They are required by California Department of Justice to keep records for one year. They can provide you with a copy. Some businesses may charge a fee. At California Registration Live Scan Notary Services, we do not charge a fee.
At times your fingerprints may be rejected because of print quality, information was missing, or incorrect information was submitted. In those instances, you will receive a rejection letter or email from DOJ or the organization that requested your fingerprints. Take that letter and return to the company that originally took and submitted your fingerprints. They should reprint you and, in most cases, DoJ will allow them to resubmit your fingerprint and waive the fees. In rare cases you may be required to pay for the service again.
The person being fingerprinted is responsible for providing the correct form and ensuring everything is completed correctly. There are numerous organizations that require a live scan for employment and volunteers. Do not expect the live scan operator to know all the variations. Ultimately, it is your responsibility to ensure that you are using the correct form. Additionally, all live scan operators should ensure that you review the computer screen to ensure that all the information was entered correctly.
